VSPA Foundation Legal Benefits

The Association will provide access to association counsel for civil claims, criminal investigations, charge of criminal conduct or administrative grievances under certain circumstances.

Coverage

The Association will provide access to association counsel for civil claims, criminal investigations, charge of criminal conduct of administrative grievances which arise out of and in the scope of employment with the Virginia Department of State Police (Department) and when such actions are within then existing General Orders policy, training or directives of the Department.

Notice – A request must be made for representation by Association counsel at the time a member receives notice of any occurrence of a civil claim, criminal investigation or charge, administrative grievance. If a member receives information which would reasonably cause he or she to believe that a claim, investigation or charge is in process or imminent, then the member shall provide notice.

Fees and costs – The legal defense benefits contained herein shall include coverage of costs related to the representation.

Eligibility – A member must be in good standing in order to be eligible for the benefits contained herein. The member must remain in good standing through the resolution of any representation for continued representation.

Occurrence – Members are entitled to legal defense representation for all occurrences covered within this policy, notwithstanding the number of occurrences in any given period of time, while the member is in good standing.
